The former Chief Justice of Supreme Court Sam Piroj Bharucha had observed that “up to 20 per cent of judges in India were corrupt.”

Is Judiciary Corrupt?

More than three-fourths (79%) of the respondents, who had been interacting with the judiciary, admitted that corruption was prevalent in the Department. Surprisingly, only 8% of those respondents felt that there was ‘no corruption’ in Judiciary. However, not much difference is seen in perception of corruption in judiciary for states having different strength of judiciary.

Experience of Corruption in Judiciary

While 38% of the respondents had experienced corruption every time they had interacted with judiciary, 53% had experienced it some time or the other. On the other hand, only 5% never experienced corruption.

Modus operandi for Bribing

During the last one year, three-fifths (59%) of respondents had paid money to lawyer, whereas 30% had paid money to court officials, and 14% to middle men to get their work done. There were higher number of respondents claiming to have paid bribe to court officials in states having low judicial strength compared to respondents from states having high judicial strength.

நீதிபதிகள் பணிநியமனத்தின்போது அவர்களின் நன்னடத்தை குறித்த போலீஸ் சான்றிதழ் அவசியம் என்று அனைத்து உயர் நீதிமன்றங்களுக்கும் உச்ச நீதிமன்றம் உத்தரவிட்டுள்ளது.

1996-ல் காஷியா முகம்மது முஜாமில் என்பவரை கூடுதல் மாவட்ட மற்றும் செஷன்ஸ் நீதிபதியாக கர்நாடக உயர் நீதிமன்றம் நியமனம் செய்தது. மூன்று ஆண்டுகள் பதவியில் இருந்த அவரை, குற்றச்சாட்டுகளின்பேரில் உயர் நீதிமன்றம் பணி நீக்கம் செய்தது.

இதை எதிர்த்து உச்ச நீதிமன்றத்தில் அவர் மேல்முறையீடு செய்தார். இந்த மனு நீதிபதிகள் பி.எஸ்.சௌகான், ஸ்வதந்தர் குமார் ஆகியோர் அடங்கிய பெஞ்சு முன் விசாரணைக்கு வந்தது.

இந்த வழக்கில், காஷியா குறித்த ஆவணங்களை நீதிபதிகள் ஆய்வு செய்தபோது பல்வேறு திடுக்கிடும் தகவல்கள் வெளிவந்தன.

மஜ்லிஸ்-இஸô-ஓ-தான்ஜிம் என்ற அமைப்பின் பொதுச்செயலராக செயல்பட்ட காஷியா, அப் பகுதி போலீஸ் நிலைய பதிவேட்டில் ரௌடிகள் பட்டியலில் இடம் பெற்றுள்ளார்.

1993-ல் பத்கல் பகுதியில் ஏற்பட்ட மதக் கலவரத்துக்கு காரணமானவர் என்பது உள்பட அவர் மீது பல்வேறு குற்றச்சாட்டுகள் உள்ளன.

ஆனால், அவரது குற்றப் பின்னணி குறித்து விசாரிக்காமல் கர்நாடக உயர் நீதிமன்ற நிர்வாகம் அவரை நீதிபதியாக நியமனம் செய்துள்ளது.

மூன்று ஆண்டுகளுக்குப் பின்னரே அவரைப் பற்றிய தகவல்கள் தெரியவந்து, பணிநீக்கம் செய்யப்பட்டுள்ளார்.

இந்த வழக்கை விசாரித்த உச்ச நீதிமன்ற நீதிபதிகள், காஷியாவின் மனுவைத் தள்ளுபடி செய்தனர்.

நீதிபதிகள் நியமனத்தின்போது, அவர்களின் நன்னடத்தை குறித்த உள்ளூர் போலீஸôரின் சான்றிதழ் அவசியம் என்றும், நீதிபதிகள் குறித்த ரகசிய ஆய்வறிக்கையை ஆண்டுதோறும் தயார் செய்ய வேண்டும் என்றும் உயர் நீதிமன்றங்களுக்கு உச்ச நீதிமன்ற நீதிபதிகள் உத்தரவிட்டனர்.

Bhopal : A man who was declared an absconder by a court in Indore worked as a judge in a superior court in the same city for years before his past caught up with him.

The Madhya Pradesh High Court has suspended Additional District and Sessions Judge Narendra Kumar Jain for concealing the matter.

As a student of Christian College in Indore, Jain, along with four friends, was involved in a brawl with a hotel owner and his son in 1983. The owner, whose nasal bone was broken, lodged a police complaint that led to the arrest of Jain and his friends.

Jain was released on bail and appeared in court once in 1985. He was declared an absconder by the court when he did not appear later despite repeated summons.

Jain cleared an examination meant for judicial officers in 1994 but suppressed the fact that he was involved in a criminal case and was facing trial.

Registrar General of Madhya Pradesh High Court T K Kaushal told The Indian Express that Jain was suspended after a vigilance inquiry. He said an inquiry had been initiated against him.

Two months ago, the High Court suspended G P Agarwal, another Additional District Judge posted in Indore. His suspension followed the seizure of his laptop after a complaint. The laptop contained two orders, one of acquittal and another conviction, in one case of chain snatching.

Agarwal alleged that a secretary he had fired, in collusion with another judge, conspired against him.

Based on the complaint, dated 19.4.2005, sent by one T.Chandran of Tirunelveli to the Registry of the High Court, to the effect that the petitioner, while working as I Additional Sub Judge, Tirunelveli had some intimacy with Tmt.Jayanthi, Head Clerk, Fast Track Court No.I, Tirunelveli, thus facilitating her to collect money from the parties in respect of the proceedings pending before the petitioner assuring favourable judgments, a discreet enquiry was conducted by the Registrar (Vigilance) High Court, Madras against the petitioner, then I Additional Sub Judge, Tirunelveli and now a District Judge, working as Sessions Judge, Mahila Court, Chengalpattu and others.

However, since the time of 15 days granted in the impugned communication to the petitioner to submit his written statement of defence has already lapsed, we grant two more weeks time, from the date of receipt of a copy of this order, to the petitioner to submit his explanation to the said memo. and the disciplinary authority is directed to complete the disciplinary proceedings in accordance with law within a period of six weeks from the date of receipt of written statement of defence from the petitioner. Consequently, M.P.Nos.1 and 2 of 2009 are also dismissed. No costs.

NEW DELHI: Supreme Court on Thursday sounded the grim warning that the criminal justice system had been subverted, with witnesses being manipulated and trials being hijacked with judges and lawyers remaining "handicapped witnesses".

Making the chilling observation, which to many only confirmed the widely held perception of the erosion of the system, a Bench comprising Justices B N Agrawal, G S Singhvi and Aftab Alam also said that the lower judiciary had decayed.

"The courts of magistrate and munsif have ceased to be an option for the common man," the Bench said and compared the lower courts to ill-equipped and ill-staffed public health centres (PHCs) in rural areas.

"Only those people go there who have no other option," said the Bench as an apparent indicator of the low measure of public faith in these courts, which are the first points of dispute settlement for the masses.
