இந்தியாவில் திருமணம் செய்யும் பெரும்பாலான இளைஞர்கள் கடைசியில் பொய் வரதட்சணை வழக்கில் சிக்கி சீரழிந்துகொண்டிருக்கிறார்கள். அதற்குக் காரணம் அவர்கள் மணந்துகொண்ட மனைவியர் மட்டும் கிடையாது. இந்திய அரசாங்கம் உட்பட அதன் ஒவ்வொரு துறையும் இணைந்து இளைஞர்கள் வாழ்வை தங்களது வருமானத்திற்காக அழித்துக்கொண்டிருக்கின்றன.
1. காவல்துறை
பொய்வரதட்சணை வழக்குக் கொடுக்க வரும் பெண்ணை தட்டிக்கேட்காமால் காசுக்காக எந்தவிதமான புகாரையும் கண்ணை மூடிக்கொண்டு FIR ஆக பதிவு செய்து எந்தவித விசாரணையும் செய்யாமல் குற்றப்பத்திரிக்கை தயார் செய்து அப்பாவி இளைஞர்களின் வாழ்வை நாசமாக்கி குடும்பத்தோடு நீதிமன்றங்களில் அலைய வைக்கும் அரசாங்கத்தின் ஒரு உறுப்புதான் காவல்துறை. இதை பல நீதிமன்ற தீர்ப்புகள் வெளிப்படையாக சொல்லியிருக்கின்றன. இதற்கு ஒரு நல்ல உதாரணம் சமீபத்திய் தில்லி உயர்நீதிமன்ற தீர்ப்பு.

4. It is surprising that such FIRs are registered by the police when neither complainant lives in Delhi nor the accused persons live in Delhi nor any part of alleged offence had taken place in Delhi. The alleged offence admittedly had taken place in USA. All the accused persons, as mentioned by the complainant, are living in USA. The complainant herself is living in USA and the father of complainant perhaps is living in Delhi and pursuing this complaint. I consider that registration of this FIR is a sordid story of working culture of Delhi police. It is this police which refuses to register FIRs in case of robberies, thefts and other heinous offences which take place on the roads of Delhi and when the complainant dare comes to police station for registration of FIR, he is made to run from one police station to another on the issue of jurisdiction itself, while the FIRs are registered when nothing happened in India and no investigation can be done by the police in India. Why such FIRs are registered is obvious. It seems registration of FIRs has been made a profitable business by some police officials. The police, in the present case, not only registered the FIR but also got lookout circulars for the petitioners issued.
2. கீழ்நிலை நீதிமன்றங்கள்
இங்குதான் காவல்துறை அனுப்பும் கட்டுக்கதையான குற்றப்பத்திரிக்கையை படித்துக்கூட பார்க்காமல் வழக்கை ஆரம்பித்து பல ஆண்டுகளாக இழுத்தடித்து அப்பாவி இளைஞர்களின் வாழ்வை அடியோடு நாசமாக்குவார்கள். இதுதான் நாட்டிலுள்ள சாதாரண குடிமகன்கள் நீதி கிடைக்கும் என்று நம்பிச் செல்லும் இடங்கள். இவற்றின் நிலை எப்படி இருக்கிறது என்று இந்திய உச்சநீதிமன்றம் சொல்லியிருக்கிறது.
NEW DELHI: Supreme Court on Thursday sounded the grim warning that the criminal justice system had been subverted, with witnesses being manipulated and trials being hijacked with judges and lawyers remaining "handicapped witnesses".
Making the chilling observation, which to many only confirmed the widely held perception of the erosion of the system, a Bench comprising Justices B N Agrawal, G S Singhvi and Aftab Alam also said that the lower judiciary had decayed.
"The courts of magistrate and munsif have ceased to be an option for the common man," the Bench said and compared the lower courts to ill-equipped and ill-staffed public health centres (PHCs) in rural areas.
"Only those people go there who have no other option," said the Bench as an apparent indicator of the low measure of public faith in these courts, which are the first points of dispute settlement for the masses.
The comment, perhaps the sharpest-ever from the apex court on the health of the country's judicial administration system..........

3. சட்டம் படித்தவர்கள்
இவர்கள் பணத்தை வாங்கிக்கொண்டு நாங்கள் யாருக்கு வேண்டுமானாலும் எப்படி வேண்டுமானாலும் பொய் வழக்குப் புகார் எழுதி உதவி செய்வோம் என்று சொல்வார்கள். கேட்டால் அது எங்களது தொழில் தர்மம் என்று சொல்லிவிடுவார்கள். சட்ட அறிவு இல்லாத பெண்கள் குடும்பப் பிரச்சனைக்கு தீர்வு காண இவர்களை அணுகினால் உடனே இவர்கள் சொல்லும் அறிவுரை பொய் வரதட்சணை வழக்குகள்தான். இப்படி சொல்லியிருப்பது தேசிய பெண்கள் வாரியமும் இந்திய உச்ச நீதிமன்றமும்.

The learned members of the Bar have enormous social responsibility and obligation to ensure that the social fiber of family life is not ruined or demolished. They must ensure that exaggerated versions of small incidents should not be reflected in the criminal complaints. Majority of the complaints are filed either on their advice or with their concurrence. The learned members of the Bar who belong to a noble profession must maintain its noble traditions and should treat every complaint under section 498-A as a basic human problem and must make serious endeavour to help the parties in arriving at an amicable resolution of that human problem. They must discharge their duties to the best of their abilities to ensure that social fiber, peace and tranquility of the society remains intact. The members of the Bar should also ensure that one complaint should not lead to multiple cases.
4. இந்திய அரசாங்கம்
இவ்வளவு அநியாயமும் நாட்டில் நடந்தாலும் கண்டும் காணாததுபோல பொறுப்பே இல்லாமல் அப்பாவி இளைஞர்களின் வாழ்க்கையைப் பாதுகாக்காமல் பெண்கள் அமைப்புகள் எதிர்ப்பு தெரிவிக்கின்றன அதனால் எங்களால் எதுவும் செய்யமுடியாது என்று உள்துறை அமைச்சகம் ஒரு அறிக்கையே வெளியிட்டுவிட்டது.
கடைசியில் இப்போது இரண்டு நாட்களுக்கு முன்பு உச்ச நீதிமன்றம் இந்த பொய் வரதட்சணை வழக்குகளிலிருந்து அப்பாவிகளைக் காப்பாற்றுங்கள் இல்லையென்றால் இந்திய சமுதாயமே அழிந்துவிடும் என்று இந்திய சட்டத்துறை அமைச்சகத்திற்கு ஒரு அறிவுரையே வழங்கிவிட்டது.

35. The criminal trials lead to immense sufferings for all concerned. Even ultimate acquittal in the trial may also not be able to wipe out the deep scars of suffering of ignominy. Unfortunately a large number of these complaints have not only flooded the courts but also have led to enormous social unrest affecting peace, harmony and happiness of the society. It is high time that the legislature must take into consideration the pragmatic realities and make suitable changes in the existing law. It is imperative for the legislature to take into consideration the informed public opinion and the pragmatic realities in consideration and make necessary changes in the relevant provisions of law. We direct the Registry to send a copy of this judgment to the Law Commission and to the Union Law Secretary, Government of India who may place it before the Hon’ble Minister for Law & Justice to take appropriate steps in the larger interest of the society.

Since the police may arrest anyone who is accused of committing a crime (even if the allegation is frivolous in nature) , the Indian criminal justice system is often used to escalate personal disagreements into criminal charges. This practice has been increasingly exploited by dissatisfied business partners, contractors, estranged spouses, or other persons with whom the U.S. citizen has a disagreement, occasionally resulting in the jailing of U.S. citizens pending resolution of their disputes. At the very least, such circumstances can delay the U.S. citizen's timely departure from India, and may result in an unintended long-term stay in the country. Corruption in India, especially at local levels, is a concern, as evidenced by Transparency International’s Corruption Perception Index of 2008, ranking India in 85th place among the world’s 180 countries.
